The TripCheck Traveler Information Portal is operated by the State
of Oregon, Department of Transportation (ODOT) with data provided
by ODOT and other public agencies. This portal provides access to
a variety of highway, state and road, and travel information data.
ODOT reserves the right to change, modify, add or discontinue any
aspect or feature of the site at any time. ODOT provides this portal
as a governmental function and as a public service.
Disclaimer
ODOT, along with other public agencies, provides the information as a free service to
the public. This information is published automatically and cannot be
guaranteed as to accuracy or timeliness. All data is provided "as is",
at user’s assumed risk, without warranty of any kind.
The updating and dissemination of this information depends on a
number of available resources, including Internet availability,
communications networks, and interconnected computer systems which
may be beyond the immediate, or any, control of ODOT or the public
agencies providing the data. Availability at any given time is not
guaranteed.
Weather and road conditions change rapidly, and drivers are in the
best position to perceive such conditions and adjust their driving
accordingly. Those relying on the foregoing information do so at
their own risk, and the State of Oregon, and public agencies providing
the data or any of their officers, employees or agents shall be
held harmless and released from any liability for the accuracy or
completeness of this information and from any actions taken in reliance
thereon.
Restrictions on Use
The content of this site, including all text, graphics, compilations
and other documentation, is the property of ODOT or the public agencies
providing the data. By using this portal, you agree to abide by
these terms of use.
Permission to Use Camera Images and other Data
ODOT
and other public agencies providing data on this site allow the
public and private business to use and circulate data published
in this portal under the following conditions:
a. Republishers must credit the public agency providing the data.
In the case of some traffic camera images the identification of
the agency providing the image is already embedded in the image,
in which case the condition to credit is already met.
b. Republisher must mirror the data found on this site. To mirror
a file means that the re-publisher's server must download a copy
periodically and use the copy on its own server on its page.
c. Republishers must repeat the disclaimer below when acknowledging
the data usage.
Disclaimer of Warranty; Limitation of Liability
ODOT and public agencies providing the data on this portal attempt
to provide the best service reasonably available, but situations
will occur that disrupt service. The updating and dissemination
of this information depends on a number of available resources,

computer systems which may be beyond the immediate control of ODOT
and availability at any given time is not guaranteed.

to this portal be liable for any direct, indirect, incidental, special
or consequential damages that result from the use of, or the inability
to use, this portal or its content.
If
you are dissatisfied in any way with any of these terms of use;
your sole and exclusive remedy is to discontinue use of this site.
Indemnification
If the State of Oregon, ODOT or any public agency, or their officers,
employees or agents, providing data to this portal is involved in
litigation as a result of use of this site, the user agrees to indemnify
said agencies and individuals; pay all costs associated with defending
the said agencies and individuals; and pay any resulting costs,
expenses, damages and liability. Notwithstanding the duty to defend,
prior written consent of legal counsel to the public agency is required,
and the public agency may at anytime, at its election, assume its
own defense at user’s expense.
Third Party Content
ODOT may provide links to Internet sites maintained by third parties.
Because ODOT does not operate or control any of these sites, ODOT
cannot be responsible for their content, including but not limited
to their accuracy.
Changed Terms
ODOT has the right at any time to change or modify the terms and
conditions applicable to use of the site or to impose new conditions.
Any use of the site indicates that the terms and conditions are
accepted by the user as posted at the time of use.
Miscellaneous
These terms of use constitute the entire agreement of the parties
with respect to the subject matter hereof and supersede all previous
written or oral agreements between the parties with respect to such
subject matter. These terms of use shall be construed in accordance
with the laws of the State of Oregon. No waiver by either party
of any breach or default hereunder shall be deemed to be a waiver
of any preceding or subsequent breach or default. The section headings
used herein are for convenience only and shall not be given any
legal import.
